Question about non-compete clauses in book contracts

I would like your opinion regarding a book contract: I currently have a contract with "Publisher X" to publish a book on search applications. I have been very happy with the editors at Publisher X, but have run into a problem with no compete.

Specifically, I wrote a book about Text Mining with "Publisher Y" and even though there is minimal overlap between the two books, the no compete is an issue. Publisher Y uses a broad interpretation of "similar subject matter" to claim that the proposed book overlaps and therefore cannot be published with Publisher X. My question is whether I should try to get the contract with Publisher X terminated and go back to Publisher Y. I doubt Y will give anything in writing to let me publish the new book and don't want to spend too much time in legal battles...

How do you get a book published?

My friend and I are writing a fictional book, it is directed towards teenagers. We are in the very beginning of writing the book. We have just finished laying down the plot and we did tons of research for different characters. We're hoping to get it published but are very confused on actually how to get it published. What is a book agent supposed to do for me as an author?

It's one of the most common questions that I hear as a writer, and just about every group of writers endlessly debates the topic: what's the purpose of an agent? Different agents have different views of what they do, and certainly authors vary in their ability to work with an agent or agency, but fundamentally, it can be a tricky business to pin down exactly how an agent should be helping a writer succeed.

How do I set a Microsoft Word document to be exactly 25 lines per page?

Do you have any idea how to set a document in Microsoft Word to have exactly 25 lines per page? That's what the agents and publishers I'm approaching want as a standard format, (1" margins and 25 lines) but every attempt I've made to do that has fallen short one way or another -- the occasional 24 or 26 lines. Along with my new book LinkedIn for Recruiting I’m putting up an online site that will hold content and links. Need an exemplary publishing contract?

Here is my problem: is there a free or an inexpensive publishing contract (template) on the Internet that I could download?

I would like to publish a series of books in Ireland, I am a not a writer but a translator. So my situation is slightly different from the usual "writer, who wants to publish his own work".

The authors are asking for the publishing contract, and I have tried going to solicitors (and there aren't many, who deal with intellectual property, and those who do do are only interested in cases where you can sue for illegal copyright use), they were not interested in a small publisher. I also learnt that a lot of publishing houses do not even use solicitors and draw up their own contracts. I decided to find either somebody else's contract or a template of a contract, amend it to suit my situation, then contact a "smaller" solicitor to verify the contract for me.

People I have talked to regarding this all worked in publishing at some stage of their lives, none of them have a contract to even show me (or so they say anyway ;). Help!

What's the best medium for my new book?

Dave, what format do you recommend for distributing a 75-page comprehensive research glossary for a popular and prolific alternative health author? Dave, I'm in a bit of a pickle. Like you, I'm an author, and as I wrap up my latest book project, the development editor sent me a note saying that all the figures I've submitted, all 217 of them, are incorrectly named and need to be fixed. Augh! The naming scheme I'm using is FIGxxyy.TIF where xx is the chapter number and yy is the figure number. To make it a bit more complex, sometimes I use a three digit figure number and other times I use a two digit value. I need all the files to be called xxFIGyyy.TIF. A colleague of mine sent me a troubling question: "Dave, I recently submitted an article to a magazine I've worked with for a few years, and they accepted it without comment. What pitfalls do I need to avoid in an authors publishing contract?

Having had oodles of experience with contract negotiation and publishing, I'm reviewing the contract that a very large publisher sent a colleague for a book she wants to write, and it amazes me how it has all the same anti-author clauses of just about every other publisher's agreement I've seen (with a few notable exceptions). This is why people who aren't familiar with the business really need to consider an agent, lawyer, or someone else who can represent their interests when reading through a legal document of this nature.

"Learning Unix for Mac OS X Panther" is out!

I received a lovely Hannukah present from O'Reilly and Associates this afternoon when FedEx delivered the first copy of Learning Unix for Mac OS X Panther. I can't stress how much it's improved over the previous editions, with both Brian Jepson and I substantially rewriting major sections, swapping out a chapter completely, and making it even more Mac-centric than it was. Yet it's still only 168 pages long, and costs about the same as two cups of latté and a scone at Starbucks.

Wrapping up "Wicked Cool Shell Scripts"

We've settled on the covert art - a retro 50's robot - and the cover copy, and I've almost completed the page proofs (only have the games chapter left). This means that the book is only weeks away from being completed, and about a month away from being published and in the distribution channels. And, as I'm reading the pages, I'm realizing that this is going to be a really fun book for anyone who has ever touched a shell script. And soon enough it'll be time to build the Web site for the book, then you'll be able to get a sneak preview of some of the new content.

We're very, very close to shipping off Learning Unix for Mac OS X Panther to the printers, after my co-author Brian Jepson and I finished going through the entire manuscript PDF with a fine-tooth comb. A number of glitches -- all ironed out, of course -- and this book is really going to be a nice addition to the library of any Mac OS X Panther user, whether you're a Unix expert or just curious about what you can accomplish if you launch Terminal.app. Stay tuned, it'll be out very soon now!

Mac OS X 10.3 Panther is coming! And so's my new book!

And if Apple ships the latest version of Mac OS X, 10.3, on 24 October (just a few weeks away!) you can bet that the Panther version of "Learning Unix for Mac OS X" isn't too far behind. It's worth noting that we have made quite substantial revisions and updates to the book, including structural changes, replacing some chapters with more interesting material, and not a page has gotten by unchanged.
